BHP amends Potash offer

September 2, 2010

BHP Billiton says it has revised its offer to take over Canadian fertiliser producer Potash Corporation of Saskatchewan, although the changes are not material.

BHP Billiton said in a statement late on Wednesday that an amendment to its offer "reflect the receipt of certain exemptive relief from the US Securities and Exchange Commission".

The changes also "reflect certain other comments to such documents received from the staff of the SEC".

But no changes had been made to the offer price of $US130, or to the other terms and conditions of the offer, BHP Billiton said.

BHP said the offer remains open until a minute before midnight on October 19, US time.

Potash Corp has rejected the $US40 billion ($A45.2 billion) takeover offer, which BHP Billiton now has taken directly to shareholders.
